Terms of Service

1. Service overview

kttouk is a personal capture platform — a desktop-first application for capturing tasks, notes, screenshots, voice, clipboard text, and bookmarks, with optional AI-based organization. The "Service" includes the kttouk desktop application and its accompanying optional components (self-hosted backend, MCP servers) as made available from the kttouk project.

These Terms of Service ("Terms") govern your use of the Service. By installing or using kttouk, you agree to these Terms.

2. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

3. Account and registration

  • The desktop app itself requires no account and can be used entirely offline.
  • If you use synchronization, you connect to a backend and create/login to an account on that backend (email, or Google/GitHub sign-in if enabled). You are responsible for safeguarding your credentials.
  • You agree to provide accurate information when registering for an account on a sync backend and to keep your account credentials confidential.

4. License

kttouk is proprietary, closed-source software. It is licensed to you, not sold. Subject to your compliance with these Terms, kttouk Team grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Service for your own personal or internal business use.

This license does not grant you any right to the Service's source code. Except as permitted by applicable law notwithstanding this restriction, you may not:

  • copy, modify, reverse-engineer, decompile, or create derivative works of the distributed application binaries;
  • redistribute, sublicense, rent, lease, or sell the Service or any part of it;
  • remove or obscure any proprietary notices in the Service;
  • use the Service to violate any law or regulation.

Third-party components distributed with kttouk (open-source libraries, fonts, and similar) remain licensed under their own respective terms; see the Service's third-party notices file for the list of those components and licenses.

5. Your content

All content you create in kttouk — tasks, notes, captures, bookmarks, projects, tags, reminders, and AI conversations — is your content. You retain all rights to it.

  • kttouk stores your content on your device and, only if you enable it, on a backend you operate and/or with an AI provider you select.
  • You are solely responsible for the content you capture, including ensuring you have the right to capture and store it.
  • kttouk does not claim ownership of, or license rights in, your content beyond what is needed to operate the features you use.

6. Synchronization

Synchronization is an optional feature that copies your content to a backend you configure. If you enable it:

  • Your content will be transmitted to and stored on that backend.
  • You are responsible for the security and availability of that backend, and for the backups and data-protection obligations that apply to the data you store on it.

7. AI features

  • AI features are optional. When enabled with a cloud provider (OpenAI, Gemini, Claude), content you use with AI features is sent to that provider and processed under their terms and privacy policies.
  • You are responsible for the content you submit to AI features and for compliance with the AI provider's acceptable-use policies.
  • kttouk does not guarantee the accuracy, completeness, or usefulness of AI-generated output. AI output may be inaccurate; verify important information before acting on it.

8. Third-party services

The Service may integrate with third-party services you connect, including AI providers, CalDAV calendar servers, and a self-hosted sync backend. Your use of those third-party services is governed by their own terms and privacy policies. kttouk is not responsible for third-party services.

9. Prohibited conduct

You agree not to use the Service to:

  • store, transmit, or generate illegal, defamatory, infringing, or abusive content;
  • violate any applicable law or regulation;
  • infringe the intellectual property rights of others;
  • interfere with or disrupt the Service or any connected service.

10. Vulnerability reporting

kttouk is proprietary software, but we take security issues seriously. Security issues should be reported privately (see the Security Policy), not filed as a public issue. We appreciate responsible disclosure and will not pursue legal action against good-faith security researchers who report vulnerabilities privately and without causing harm.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NOT BE LOST. YOU ARE RESPONSIBLE FOR BACKING UP YOUR DATA.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE kttouk PROJECT AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM (OR, IF YOU PAID NOTHING, THE MAXIMUM AMOUNT PERMITTED BY APPLICABLE LAW).

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the kttouk project and its contributors from and against any claims, damages, and expenses arising from your use of the Service or your violation of these Terms.

14. Modifications

We may update these Terms from time to time. We will indicate changes by updating the version number and effective date at the top of this document. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Service.

15. Termination

You may stop using the Service at any time and delete your data. We may terminate or suspend access to the Service (including a sync backend we operate) for violations of these Terms, at our discretion and to the extent permitted by law.

16. Governing law and disputes

These Terms are governed by the laws applicable in the jurisdiction of the kttouk project, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction, unless otherwise required by mandatory law where you reside.

17. Severability and waiver

If any provision of these Terms is found to be unenforceable, that provision shall be limited or eliminated to the minimum extent necessary and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right.
